  1. The Campaign.
    The “Yes x iQIYI” Campaign (“Campaign”) is a time limited campaign launched by YTL Communications Sdn. Bhd. (“YTLC”) (Company No. 200701035605 (793634-V)) operating under the brand name “Yes” in collaboration with iQIYI INTERNATIONAL SINGAPORE PRIVATE LIMITED (Company Registration Number: 202004759W) (“iQIYI Singapore”) who owns and operates the subscription video on-demand over the top streaming services known as “iQIYI”. This Campaign shall be governed by these terms and conditions (“Campaign Terms”).  
    This Campaign offers IQIYI Free Access to new customers who subscribed to any of the Selected Service Plan during the Campaign Period. By participating in this Campaign, the customer confirms and acknowledges that he/she has read and understood and agrees to be bound by these Campaign Terms. Capitalised words shall have the meaning ascribed to it in Section 10 below.
  2.  Campaign Eligibility.
    To be eligible to participate in this Campaign, the customer must be at least 18 years of age and must sign up for at least one (1) Selected Service Plan during the Campaign Period, provided that the customer does not: (a) have any outstanding payments with Yes, and/or (b) have in aggregate more than fifteen (15) existing Postpaid Service Plan registered with Yes (“Eligible Subscriber”). The Eligible Subscriber shall be responsible to ensure that the email address used to subscribe to the Selected Service Plan is identical to the email address used (or will be used) to register for an account on the iQIYI Platform.
  3. Applicable Terms.
    Save as expressly varied and set out herein, the General Terms and Conditions shall remain enforceable and are incorporated to these Campaign Terms as if the General Terms and Conditions are stated in full herein. In the event of any conflict or inconsistencies between the General Terms and Conditions and these Campaign Terms, these Campaign Terms shall prevail only to the extent to resolve any such conflict or inconsistencies. Words in capital not defined herein shall have the same meaning ascribed to them in the General Terms and Conditions.
  4. Campaign Period.
    The Campaign will commence on 18th December 2025 until further notice (“Campaign Period”). YTLC shall have the sole and absolute discretion to extend and/or vary the Campaign Period and Campaign Terms without prior notification.
  5. Campaign Mechanics.
    5.1 Upon the subscription of a Selected Service Plan, the Eligible Subscriber shall be granted Free one (1) year iQIYI Access, which must be activated on the iQIYI Platform no later than thirty (30) days from the date of activation of the Selected Service Plan. For the avoidance of doubt, all access and use of the iQIYI Platform are subject to the applicable terms and privacy policy of iQIYI Singapore (collectively, “iQIYI Terms”).
    5.2 The details of the iQIYI Free Access are as follows:

    5.3 The Eligible Subscribers must provide a valid email address upon registration, and the same email address shall be used to register for an account on the iQIYI Platform. 
    5.4 During the subsistence of the iQIYI Free Access, the iQIYI Free Access shall be forfeited if the Eligible Subscriber: (a) varies the Selected Service Plan, (b) terminates the Selected Service Plan (c) cause the Service Account to be suspended and/or terminated, or (d) deletes his/her iQIYI account after activation.
    5.5 Upon the expiry of the iQIYI Free Access, the access and use of the iQIYI Services shall be subject to iQIYI’s Terms and all such applicable rates or charges imposed by iQIYI Singapore.
    5.6 The Eligible Subscriber may subscribe to multiple Selected Service Plans and to ensure that the iQIYI Free Access is uninterrupted, the Eligible Subscriber shall ensure that the Selected Service Plan is Active.

  6. Charges and Refund.
    The Eligible Subscriber shall be responsible for payment of all charges associated with this Campaign and the Selected Service Plan(s) subscribed to during and after the Campaign Period. There shall be no refunds to any such payments made during, arising from or in connection with the Campaign for any reasons whatsoever.
  7. Limitation of Liability.
    7.1 By participating in this Campaign, each Participant agrees and irrevocably and unconditionally undertakes to absolve YTLC of all liabilities and further agrees to indemnify YTLC on indemnity basis and hold YTLC harmless against any claim (including any third-party claims) and against any loss, damage, cost or expense (including legal fees and costs) that YTLC may suffer or incur as a result of or in connection with this Campaign.
    7.2 YTLC shall not be liable for any loss or damage (including but not limited to loss of use, loss of income, profits or goodwill, direct or indirect, incidental, consequential, exemplary, punitive or special damages of any party including third parties) howsoever arising whether in contract, tort, negligence or otherwise, pursuant to or in connection with these Campaign Terms.
    7.3 To the fullest extent permitted by law, YTLC and its respective parent companies, subsidiaries, affiliates, licensees, directors, officers, employees, agents and independent contractors hereby expressly excludes and disclaims any representations, warranties, or endorsements, express or implied, written or oral, including but not limited to, any warranty of quality, merchantability or fitness for a particular purpose of enjoyment of the service offerings under this Campaign.
  8. Laws.
    This Campaign shall in all respect be governed by the laws of Malaysia.
  9. Miscellaneous
    9.1 YTLC reserves sole discretion on eligibility, activation, and forfeiture of the iQIYI Free Access, and all decisions rendered are final and non-appealable.
    9.2 YTLC reserves the right to, at any time, add to, delete, vary, or amend the Campaign Terms or change or modify any aspect of the Campaign, in whole or in part at any time and from time to time and at its sole discretion without notice and without liability to the Eligible Subscribers or any other party. Without prejudice to the aforesaid, YTLC reserves the right to cancel, terminate or suspend this Campaign at any time before or during the Campaign Period without any liability or compensation to the Eligible Subscriber whatsoever.
    9.3 This Campaign (including but not limited to the iQIYI Free Access) is not valid with other ongoing campaign or promotion and is not exchangeable for cash or credit-in-kind.
    9.4 YTLC shall not be responsible for any content streamed, broadcasted, and/or published in iQIYI and/or any activity carried out thereon.
  10. Definitions
    “Active”
    means the period during which the Eligible Subscriber’s account remains active, not barred or suspended.
    “Device” shall mean personal computer, electronic tablet, mobile phone, and media streaming devices, smart television, or any similar devices.
    “iQIYI Free Access” means the one (1) year free access to the Standard VIP Yearly package on the iQIYI Platform granted to Eligible Subscribers pursuant to this Campaign.
    “iQIYI Platform” means the iQIYI mobile application for streaming of the iQIYI Services made available for download from the Apple App Store or Google Play Store, or alternatively, the webpage at https://www.iq.com.
    “iQIYI Services” means the streaming services provided and operated by iQIYI Singapore, accessible on the iQIYI Platform.
    General Terms and Conditions” means all such terms and conditions as stipulated in the (a) Postpaid Service Terms and Conditions, (b) Postpaid Service Plans Terms and Conditions, (c) Yes 5G Wireless Broadband Postpaid Service Plans Terms and Conditions, and (d) Yes 5G Wireless Broadband Gateway Postpaid Exclusive Plan and all such applicable terms and conditions published on www.yes.my/docs/tnc.
    “Selected Service Plan” means any of the Yes 5G Gateway Wireless Broadband Service Plan.

  1. Introduction.
    The Yes 5G Wireless Broadband Postpaid Service Plans Programme (“Programme”) are service plans offered by YTL Communications Sdn Bhd (Company No. 200701035605 (793634-V)) (“YTLC”) operating under the brand name “Yes”. By subscribing and/or using the Yes 5G Wireless Broadband Postpaid Service Plans Programme, each Yes Subscriber agrees and acknowledges that he/she understands these Yes 5G Wireless Broadband Postpaid Service Plans Programme T&Cs (as defined below) and agree to abide by them.

  2. Eligibility.
    This Programme is open to all individuals residing in Malaysia who are 18 years of age or above at the time of subscription (“Eligible Subscribers”).

  3. Applicable Terms and Conditions.
    Subject only to the variations as expressly set out herein (“Programme T&Cs”), all other terms and conditions in the Postpaid Service Terms and ConditionsPostpaid Service Plans Terms and ConditionsYes 4G Broadband Plans Terms & Conditions, and the Yes Wireless Fibre Service Plan Terms and Conditions available at www.yes.my/tnc shall remain valid and applicable to this Yes 5G Wireless Broadband Postpaid Service Plans Programme (collectively, “General Applicable T&Cs”). In the event of any inconsistency between the terms and conditions of any of the General Applicable T&Cs and these Yes 5G Wireless Broadband Postpaid Service Plans Programme T&Cs, these Yes 5G Wireless Broadband Postpaid Service Plans Programme T&Cs shall prevail to the extent of any such inconsistency unless stated otherwise herein. Words in capital not defined herein shall have the same meaning ascribed to them in the General Applicable T&Cs.

  4. Programme Period.
    4.1 The Yes 5G Wireless Broadband Postpaid Service Plans Programme is available for subscription from 15th May 2025 onwards until further notice (“Term”).
    4.2 4.2 The Yes 5G Wireless Broadband Gateway 36M plan is available for subscription from 9th October 2025 until further notice (“Term”)

  5. The Programme.
    5.1 The following will be provided to the Yes Subscriber who has subscribed to the Yes 5G Wireless Broadband Postpaid Service Plans Programme;

    (a) a Yes Infinite Gateway MAX Router (“Device”); and
    (b) a Yes SIM consisting of one (1) Yes SIM (“Yes SIM”). The Yes SIM provided under this Programme cannot be used in smartphones.
    5.2 The service offerings of the Yes 5G Wireless Broadband Postpaid Service Plans Programme are as stated below:

    5.3 If you wish to add supplementary lines under the Yes 5G Wireless Broadband Postpaid Service Plans Programme, you can do so by visiting Yes Store, Yes Authorised Dealers or via MyYes You may refer to Infinite Supplementary Line s Terms & Conditions on the available supplementary line(s).
    5.4 The device is SIM-locked and specially configured to work with Yes network, even after the contract ends. SIM cards from other telcos are not compatible and will not work with Yes devices. 
    5.5 Download or upload speeds may apply to the Yes 5G Wireless Broadband Postpaid Service Plans Programme. Notwithstanding the aforesaid, the actual download or upload speed may have certain limitations and/or may vary depending on various factors including the Device or Subscriber Equipment used by You, the network coverage limitation and the number of simultaneous Yes Subscribers and/or users at the time of access. This would mean that You may not always enjoy continuous maximum speed each time You browse the internet.
    5.6 You may subscribe to one or more Yes 5G Wireless Broadband Postpaid Service Plans Programme provided always that You do not have, in aggregate, more than fifteen (15) registered with Yes. However, the Yes 5G Wireless Broadband Gateway 36M plan is limited to one subscription per MyKad / Passport holder, subject to Clause 5.2 above. 
    5.7 Upon subscription to the Yes 5G Wireless Broadband Postpaid Service Plans Programme via online purchase, You are required to perform a one-time activation of the Yes SIM within seven (7) days from the date of Yes SIM subscription, under the Yes 5G Wireless Broadband Postpaid Service Plans Programme, failing which the Yes SIM will automatically activate.
    5.8 You may enjoy the service offerings with uncapped 5G or 4G internet speed (internet speed will vary depending on whether You are in 5G or 4G coverage).
    5.9 Please take note that certain areas may not be under 5G network coverage. In such instance, You will continue to enjoy uninterrupted 4G connectivity on Yes network.
    5.10 If You are found to have breached any of the term in these Yes 5G Wireless Broadband Postpaid Service Plans Programme T&Cs, we have the right to throttle the speed of Your Service or suspend or terminate Your account.
    5.11 The data services enjoyed by You through Your subscription of any of the Yes 5G Wireless Broadband Postpaid Service Plans Programme is exclusive for Your use in Malaysia. You are not entitled to use the Data Capacity Allocation if You are outside Malaysia.
    5.12 In the event that You have exhausted the 4G data allocated to You before the end of a particular Billing Cycle, Your data speed will be reduced for the remaining period of the said Billing Cycle at a throttled speed of 256 kbps on a best effort basis. You may purchase our Data Add-ons. For clarity, any mention on speed shall mean the optimum speed which means the actual speed enjoyed by You may vary depending on various other factors including but not limited to technical and environmental factors.
    5.13 The suspension of the Yes 5G Wireless Broadband Postpaid Service Plans Programme will apply simultaneously to supplementary line users subscribed under the Yes 5G Wireless Broadband Postpaid Service Plans Programme. Notwithstanding the suspension of such Yes 5G Wireless Broadband Postpaid Service Plans Programme, the commitment to pay the Commitment Fee shall continue during the period of suspension. 

  6. Charges. 
    The applicable charges on the Yes 5G Wireless Broadband Postpaid Service Plans Programme available for subscription are published in our official website @yes.my and are exclusive of SST. Any such applicable SST will be added to the charges and be reflected in Your Bill.

  7. Plan Advance Payment & Activation Fees.
    7.1 A Plan Advance Payment, Activation Fees and/or Upfront Payment (as defined below) may apply (please refer to our official website @yes.my). In such event, the Plan Advance Payment, Activation Fees and/or Upfront Payment shall be payable prior to the subscription of this Yes 5G Wireless Broadband Postpaid Service Plans Programme.

    7.2 If You are a non-Malaysian, a deposit sum of RM 200 will be collected by Yes (“Foreigner Deposit”) for each of the Yes 5G Wireless Broadband Postpaid Service Plans Programme subscribed by You, and will be refunded to You, free of interest, sixty (60) days from the final bill statement date after the termination of the Service, subject to any deduction of any outstanding sum which may be due to Yes.

  8. 7 Days Return Policy.
    8.1 You may submit a request to terminate Your account under Our 7 Days Return Policy if:

    (a) You have no or slow Service connection at Your registered premise; and
    (b) Your data usage consumption at Your registered premise is less than 10GB (4G + 5G); and
    (c) Your request for termination is made within seven (7) days from the date of Your SIM activation.
    8.2 Your request for termination pursuant to Clause 8.1 above may be made in the following manner:
    (a) If You made Your purchase online, you can proceed to any Yes Stores/Kiosks;
    (b) If You made Your purchase in person at a particular Yes Store/Kiosk, You must return to the original Yes Store/Kiosk that you made the purchase from.
    8.3 Upon Our verification of Clauses 8.1(a) and (b) above, we will terminate Your account and refund all payments You had made under the Yes 5G Wireless Broadband Postpaid Service Plans Programme within sixty (60) days from the date of return of the complete Device (including the Infinite Gateway MAX Router, power cord and Quick Yes user Guide) in its original condition to Our Yes Store/Kiosk.
    8.4 If Your request for termination is not submitted on or before the seventh (7th) day from the Yes SIM activation date or if Your request has been rejected by Yes, the Yes 5G Wireless Broadband Postpaid Service Plans Programme service shall continue and You will be obliged to make all necessary payments thereunder.

  9. Subscription Channels.
    9.1 Subject to Clause 2 above, You may subscribe to the Yes 5G Wireless Broadband Postpaid Service Plans Programme through yes.my, MyYes app, Yes Authorised Dealers and Yes Stores.

    9.2 Subject to Clauses 2 and 5.3 above, You may subscribe for additional supplementary lines under the Yes 5G Wireless Broadband Postpaid Service Plans Programme through MyYes app, Yes Authorised Dealers and Yes Stores.

  10. Additional/Removal of Service Plans.
    We reserve the right to add and/or remove any service offerings under the Yes 5G Wireless Broadband Postpaid Service Plans Programme without notice and liability to You and any other Party.

  11. Warranty.
    The Device provided to You as part of the Yes 5G Wireless Broadband Postpaid Service Plans Programme is subject to Yes limited warranty at www.yes.my/tnc.

  12. Exclusion of liability on use of Device.
    Yes shall not be liable to any Eligible Subscriber and/or Yes Subscriber or any person(s) claiming through them for any loss, damages or injury arising from the use or inability to use the Device from any cause whatsoever.

  13. Refund.
    There shall be no refund under the Yes 5G Wireless Broadband Postpaid Service Plans Programme for any reasons whatsoever.

  14. Termination.
    Subject to the termination conditions stipulated in the General Applicable T&Cs, a Yes Subscriber can terminate Yes 5G Wireless Broadband Postpaid Service Plans Programme subscribed by issuing to Yes a notice in Yes prescribed format and supported by all required relevant documents for verification.

  15. Early Termination Charges (ETC).
    If a Yes Subscriber terminates his/her Service account or ports out to another service provider at any time before the expiry of the Contract Period or if the Service account is terminated by Yes as a result of such Eligible Subscriber’s breach of these Yes 5G Wireless Broadband Postpaid Service Plans Programme T&Cs and/or the General Applicable T&Cs, such Eligible Subscriber shall be subjected to Early Termination Charges. Please refer to the Postpaid Service Terms and Conditions for further details on the Early Termination Charges.

  16. Upgrade/Downgrade.
    Yes Subscribers are not allowed to upgrade or downgrade their Yes 5G Wireless Broadband Postpaid Service Plans Programme during the Contract Period.

  17. Limitation of Liability.
    Yes shall not be liable for any loss or damage (including without limitation loss of use, loss of income, profits or goodwill, direct or indirect, incidental, consequential, exemplary, punitive or special damages of any party including third parties) howsoever arising whether in contract, tort, negligence or otherwise, in connection with this Yes 5G Wireless Broadband Postpaid Service Plans Programme T&Cs.

  18. Laws.
    This Yes 5G Wireless Broadband Postpaid Service Plans Programme shall be governed by the laws of Malaysia under the jurisdiction of the Malaysian courts.

  19. Modifications.
    Yes reserves the right to, at any time, add to, delete, vary or amend the terms and conditions herein or change or modify any aspect of the Yes 5G Wireless Broadband Postpaid Service Plans Programme, in whole or in part at any time and from time to time and at its sole discretion without notice and without liability to You or any other party. Without prejudice to the aforesaid, Yes reserves the right to cancel, terminate or suspend the Yes 5G Wireless Broadband Postpaid Service Plans Programme at any time before or during the Yes 5G Wireless Broadband Postpaid Service Plans Programme Period with notice but without any liability or compensation whatsoever.

  20. Definitions.
    All capitalized terms and expressions in these Yes 5G Wireless Broadband Postpaid Service Plans Programme T&Cs, unless defined herein, shall have the same meanings ascribed to them in the Postpaid Service Terms and Conditions:
    Activation Fee” means a one-time fee which is non-refundable imposed on the Yes Subscriber upon subscription of any of the Yes 5G Wireless Broadband Postpaid Service Plans Programme.
    Foreigner Deposit” shall have the same meaning ascribed to in Clause 7.2 herein.
    Plan Advance Payment” means the relevant Commitment Fee collected in advance at the time of registration of the Yes 5G Wireless Broadband Postpaid Service Plans Programme.
    Upfront payment” means the relevant Fee collected in advance at the time of registration of the Yes 5G Wireless Broadband Postpaid Service Plans Programme.
    SST” means any sales and services tax or any similar value added tax on the sale of goods or the provision of services in accordance to the Sales Tax Act 2018 and/or the Service Tax Act 2018.

  1. Introduction.
    The Yes 5G Wireless Broadband Gateway Postpaid Exclusive Service Plan (“Programme”) is a service plan offered by YTL Communications Sdn Bhd (Company No. 200701035605 (793634-V)) (“YTLC”) operating under the brand name “Yes”. By subscribing and/or using the Programme, each Yes Subscriber agrees and acknowledges that he/she understands these Programme T&Cs (as defined below) and agree to abide by them.

  2. Eligibility.
    The Programme is open for subscription to all individuals who fulfil the following conditions:-

    (i) Malaysians or non-Malaysians residing in Malaysia, who are 18 years and above; and
    (ii) Customers with a Yes Postpaid plan (with an active account status), and must maintain both plans throughout the contract period, collectively (“Eligible Subscribers”).

  3. Applicable Terms and Conditions.
    Subject only to the variations as expressly set out herein (“Programme T&Cs”), all other terms and conditions in the 
    Postpaid Service Terms and ConditionsPostpaid Service Plans Terms and Conditions, Yes 4G Broadband Plans Terms & Conditions, and the Yes Wireless Fibre Service Plan Terms and Conditions available at www.yes.my/tnc shall remain valid and applicable to this Programme (collectively, “General Applicable T&Cs”). In the event of any inconsistency between the terms and conditions of any of the General Applicable T&Cs and these Programme T&Cs, these Programme T&Cs shall prevail to the extent of any such inconsistency unless stated otherwise herein. Words in capital not defined herein shall have the same meaning ascribed to them in the General Applicable T&Cs.

  4. Programme Period.
    The Programme is available for subscription from 30th August 2024 onwards until further notice (“Term”).

  5. The Programme.
    5.1. The following will be provided to the Yes Subscriber who has subscribed to the Programme:

    (a)  a Yes 5G Infinite Gateway router (“Device”); and
    (b)  a Yes SIM consisting of one (1) Yes SIM (“Yes SIM”). The Yes SIM provided under this Programme cannot be used in smartphones.

    5.2 The service offerings of the Programme are as stated below:

    *Effective 13th December 2024, the 4G data has been increased from 150GB to 500GB. All existing customers will be automatically upgraded to the new data quota. 

    5.3 Download or upload speeds may apply to the Programme. Notwithstanding the aforesaid, the actual download or upload speed may have certain limitations and/or may vary depending on various factors including the Device or Subscriber Equipment used by You, the network coverage limitation and the number of simultaneous Yes Subscribers and/or users at the time of access. This would mean that You may not always enjoy continuous maximum speed each time You browse the internet.
    5.4 The device is SIM-locked and specially configured to work with Yes network, even after the contract ends. SIM from other telecommunications providers are not compatible and will not work with Yes devices. 

    5.5 You may subscribe to one Programme provided always that You do not have, in aggregate, more than fifteen (15) Postpaid Service Plans registered with Yes.
    5.6 Upon subscription to the Programme via online purchase, You are required to perform a one-time activation of the yes SIM within seven (7) days from the date of Yes SIM subscription under the Programme, failing which the Yes SIM will automatically activate. 
    5.7 You may enjoy the service offerings with an uncapped 5G or 4G (up to 150GB) internet speed (Internet speed will vary depending on whether You are in 5G or 4G coverage).
    5.8 Please take note that certain areas may not be under 5G network coverage. In such instance, You will continue to enjoy uninterrupted 4G connectivity on Yes network.
    5.9 If You are found to have breached any of the term in these Programme T&Cs, We have the right to throttle the speed of Your Service, suspend, or terminate Your account.
    5.10 The data services enjoyed by You as offered under Your subscription of the Programme is exclusive for Your use in Malaysia only. You are not entitled to use the Data Capacity Allocation if You are outside Malaysia.
    5.11 In the event that You have exhausted the 4G data allocated to You under Your subscription of the Programme before the end of a particular Billing Cycle, Your data speed will be reduced for the remaining period of the said Billing Cycle at a throttled speed of 256 kbps on a best effort basis. You may purchase Yes
    Data Add-ons to continue enjoy full speed 4G data. For clarity, any mention on speed shall mean the optimum speed which means the actual speed enjoyed by You may vary depending on various other factors including but not limited to technical and environmental factors.
    5.12 The suspension of the Programme will apply simultaneously to supplementary line users subscribed under the Programme. Notwithstanding the suspension of such Programme, the commitment to pay the Commitment Fee shall continue during the period of such suspension. 

  6. Charges.
    The applicable charges on the current Programme available for subscription are published on our official website at yes.myand are exclusive of SST. Any such applicable SST will be added to the charges and be reflected in Your Bill.

  7. Plan Advance Payment & Activation Fees.
    7.1 A Plan Advance Payment, Activation Fees and/or Upfront Payment (as defined below) may apply (please refer to our official website @
    yes.my). In such event, the Plan Advance Payment, Activation Fees and/or Upfront Payment shall be payable prior to the subscription of the Programme.
    7.2 If You are a non-Malaysian, a deposit sum of RM 200 will be collected by Yes (“Foreigner Deposit”) for each of the Programme(s) subscribed by You, and will be refunded to You, free of interest, sixty (60) days after the termination of the Service, subject to any deduction of any outstanding sum which may be due to Yes.

  8. 7 Days Return Policy.
    8.1 You may submit a request to terminate Your account under Our 7 Days Return Policy if:
    (i) You have no or slow Service connection at Your registered premise; and
    (ii) Your data usage consumption at Your registered premise is less than 10GB (4G + 5G); and
    (iii) Your request for termination is made within seven (7) days from the date of Your SIM activation.
    8.2 Your request for termination pursuant to Clause 7.1 above may be made in the following manner:
    (i) If You made Your subscription online or in person at any Yes Kiosk, you can proceed to any Yes Store;
    (ii) If You made Your subscription in person at a particular Yes Store, You must return to the Yes Store that where you made Your subscription at.
    8.3 Upon Our verification of Clauses 7.1(i) and (ii) above, we will terminate Your account and refund all payments You had made under the Programme within sixty (60) days from the date of return of the complete Device (including the Yes 5G Wireless Gateway router, power cord and Quick Yes user Guide) in its original condition to Our Yes Store.
    8.4 If Your request for termination is not submitted on or before the seventh day from the SIM activation date or if Your request has been rejected by Yes, the service offerings under the Programme shall continue and You will be obliged to make all necessary payments thereunder.

  9. Subscription Channels.
    Subject to Clause 2 above, You may subscribe to Programme through yes.my, MyYes app, Yes Authorised Dealers and Yes Stores.

  10. Additional/Removal of Postpaid Service Plan.
    We reserve the right to add and/or remove any service offerings under the Programme without notice and liability to You and any other party.

  11. Warranty.
    The Device provided to You as part of the Programme is subject to Yes limited warranty at www.yes.my/tnc.

  12. Exclusion of liability on use of Device.
    Yes shall not be liable to any Eligible Subscriber and/or Yes Subscriber or any person(s) claiming through them for any loss, damages or injury arising from the use or inability to use the Device from any cause whatsoever.

  13. Refund.
    There shall be no refund under the Programme for any reasons whatsoever, unless stated otherwise in these Programme T&Cs.

  14. Termination.
    Subject to the termination conditions stipulated in the General Applicable T&Cs, a Yes Subscriber can terminate the Yes 5G Wireless Broadband Gateway Postpaid Exclusive Service Plan subscribed by issuing to Yes a notice in Yes prescribed format and supported by all required relevant documents for verification.

  15. Early Termination Charges (ETC).
    If a Yes Subscriber terminates his/her Service account or ports out to another service provider at any time before the expiry of the Contract Period or if the Service account is terminated by Yes as a result of such Eligible Subscriber’s breach of these Programme T&Cs and/or the General Applicable T&Cs, such Eligible Subscriber shall be subjected to Early Termination Charges. Please refer to the
    Postpaid Service Terms and Conditions for further details on the Early Termination Charges.

  16. Upgrade/Downgrade.
    Yes Subscribers are not allowed to upgrade or downgrade their Programme during the Contract Period.

  17. Limitation of Liability.
    Yes shall not be liable for any loss or damage (including without limitation loss of use, loss of income, profits or goodwill, direct or indirect, incidental, consequential, exemplary, punitive or special damages of any party including third parties) howsoever arising whether in contract, tort, negligence or otherwise, in connection with this Programme T&Cs.

  18. Laws.
    This Programme shall be governed by the laws of Malaysia under the jurisdiction of the Malaysian courts.

  19. Modifications.
    Yes reserves the right to, at any time, add to, delete, vary or amend the terms and conditions herein or change or modify any aspect of the Programme, in whole or in part at any time and from time to time and at its sole discretion without notice and without liability to You or any other party. Without prejudice to the aforesaid, Yes reserves the right to cancel, terminate or suspend the Programme at any time before or during the Programme Period with notice but without any liability or compensation whatsoever.

  20. Definitions. 
    Save for the defined terms as listed hereinbelow under this Clause 20, all capitalized terms and expressions in these Programme T&Cs, shall have the same meanings ascribed to them in the Postpaid Service Terms and Conditions:
    “Activation Fee” means a one-time fee which is non-refundable imposed on the Yes Subscriber upon subscription of the Programme.
    “Foreigner Deposit” shall have the same meaning ascribed to in Clause 7.2 herein.
    “Plan Advance Payment” means the relevant Commitment Fee collected in advance at the time of registration of the Programme.
    “Upfront payment” means the relevant Fee collected in advance at the time of registration of the Programme.
    “SST” means any sales and services tax or any similar value added tax on the sale of goods or the provision of services in accordance to the Sales Tax Act 2018 and/or the Service Tax Act 2018.
